These Terms of Service ("Terms") govern your use of the IAG Performance website at iagperformance.com and your purchase of products and services from IAG Performance ("IAG," "we," "us," or "our"). By accessing this website, creating an account, or placing an order, you agree to these Terms.

If you do not agree to these Terms, do not use this website or place an order.

1. Acceptance at checkout

When you complete a purchase, you confirm that you have read, understood, and agree to these Terms, our Refund Policy, and our Shipping Policy. You must agree to these Terms before your order can be completed.

3. Orders, pricing, and payment

3.1 Order acceptance

Your receipt of an order confirmation does not signify our acceptance of your order. We reserve the right to accept or decline any order for any reason, including product availability, errors in pricing or product information, suspected fraud, or restrictions on shipping to your location.

3.2 Pricing and typographical errors

We make every effort to display accurate prices, product descriptions, and application information. If a product is listed at an incorrect price or with incorrect application or specification information, we reserve the right to refuse or cancel any order — even if the order has been confirmed or your payment method has been charged. If your payment was processed, we will issue a credit to your original payment method.

3.3 Cancellations

Order cancellations are subject to a 20% cancellation fee. Engine orders are final and cannot be cancelled.

3.4 Payment

Payment is due at the time of purchase unless otherwise agreed in writing. We accept payment methods displayed at checkout. You represent that you are authorized to use the payment method provided.

3.5 Sale pricing

Sale pricing is valid only during the stated promotional period. Prices will not be adjusted for purchases made outside the sale period. Rain checks are not offered.

4. Returns and refunds

The following is a summary of our return policy. Full details are available on our Returns page and in our Refund Policy.

Return window: Stocking products may be returned within 30 days of purchase, subject to approval.
Restocking fee: Approved returns are subject to a 20% restocking fee.
Shipping on returns: Customers are responsible for return shipping costs. If the original order qualified for free shipping, shipping costs are deducted from the refund.
Inspection periods: You have 14 days to inspect your shipment for missing items and 30 days to report damaged or incorrect items. After these periods, IAG is no longer responsible for missing, damaged, or incorrect items.
RMA required: All returns require a Return Merchandise Authorization (RMA) number before items are shipped back. Contact us at 410-840-3555 or support@iagperformance.com, or submit a request through our Returns page. Items returned without an RMA may be refused.
Non-returnable items: The following are not eligible for return: engines; special-order and made-to-order items; electrical components including the COBB Accessport; and any product that has been installed, used, or modified. Some products may need to be returned to the manufacturer for inspection before a return or exchange can be processed.
Refunds: Refunds are processed within 30 days or less. Credit card, Affirm, and PayPal payments are refunded to the original payment method. Cash purchases are refunded by business check. Refund decisions are made by management.
Lost packages: Lost packages will be replaced — not refunded — pending approval of a carrier claim.

5. Shipping and delivery

The following is a summary of our shipping practices. Full details are available on our Shipping page and in our Shipping Policy.

Carriers: Orders ship via UPS, USPS, or freight carriers as appropriate.
Processing time: Most in-stock orders ship within 1–3 business days. Built-to-order, engine, and special-order items may require additional lead time.
Free shipping: When free shipping is offered, IAG reserves the right to select the lowest-cost eligible shipping method, which may differ from the method selected at checkout.
Insurance: Packages include shipping insurance. USPS insured orders over $200 require signature confirmation.
Tracking: Tracking numbers are emailed when your order ships.
Damaged shipments: If package contents are damaged during delivery, notify the carrier at the time of delivery and file a claim with the shipper.
Drop shipping: Some items ship directly from manufacturer or distributor warehouses. This may shorten or extend delivery by 1–3 business days.
International orders: International orders may be subject to customs duties, taxes, and brokerage fees. These charges are the customer's responsibility. IAG is not responsible for international customs charges or delays.

6. Products, installation, and use

6.1 Intended use

Many IAG Performance products are designed for off-road, competition, or racing use only where permitted by law. It is your responsibility to ensure that any product you purchase complies with applicable federal, state, and local laws, including emissions regulations. IAG Performance makes no representation that any product is legal for use on public roads or highways in all jurisdictions.

6.2 Installation and use

Products must be installed and used in accordance with manufacturer instructions and applicable industry standards. Improper installation, modification, tuning, or use may result in product failure, property damage, personal injury, or voided warranty coverage. IAG Performance is not responsible for damage or injury resulting from improper installation, modification, or use of products purchased from us.

6.3 Product information

Product descriptions, specifications, fitment information, and recommendations are provided for convenience. You are responsible for verifying fitment and suitability for your application before purchase. Contact us if you have questions before ordering.

6.4 Engine orders

Engine orders are final. No cancellations or returns are offered on engine purchases. Engine builds and special-order components may require substantial lead times.

7. Services and appointments

Cancelled service appointments with deposits are non-refundable.
Tuning deposits are non-refundable.
Service work is subject to separate estimates, agreements, and shop policies provided at the time of service.

8. Promotions and discounts

IAG Performance may offer promotions, rebates, or discounts from time to time. Unless stated otherwise:

Discounts cannot be combined with other offers unless explicitly permitted.
Military and first-responder discounts (where offered) apply to qualifying IAG products and cannot be applied to sale-priced items unless stated otherwise.
We reserve the right to modify or discontinue promotions at any time.

9. Website use

You agree not to use this website to:

Violate any applicable law or regulation.
Transmit unlawful, abusive, defamatory, or infringing content.
Interfere with the operation or security of the website.
Attempt unauthorized access to our systems, accounts, or data.
Scrape, harvest, or use automated means to access the site without our permission.

We may suspend or terminate access to the website at any time for conduct that violates these Terms or is otherwise harmful to IAG Performance or other users.

10. Intellectual property

All content on this website — including text, graphics, logos, images, and software — is the property of IAG Performance or its licensors and is protected by United States and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from site content without our prior written consent.

IAG Performance trademarks and trade names may not be used without permission.

11. Third-party links

This website may contain links to third-party websites. IAG Performance does not control and is not responsible for the content, policies, or practices of linked sites. Access linked sites at your own risk.

12. Disclaimers

This website and all products and services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. Some jurisdictions do not allow limitations on implied warranties, so some of the above may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, IAG Performance shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or purchase of products or services, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from these Terms or your purchase shall not exceed the amount you paid to IAG Performance for the product or service giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless IAG Performance and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your use of the website, or your misuse of products purchased from us.

15. Privacy

Your use of this website is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

16. Governing law and disputes

These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law principles. You agree that any legal action arising from these Terms or your use of this website shall be brought exclusively in the state or federal courts located in Carroll County, Maryland.

Any claim or cause of action must be commenced within one (1) year after it arises, to the extent permitted by law.

17. Changes to these Terms

We may update these Terms at any time by posting revised Terms on this website. The "Effective date" at the top of this page indicates when the Terms were last updated. Continued use of the website or placement of orders after changes are posted constitutes acceptance of the revised Terms.

18. General provisions

Entire agreement: These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, constitute the entire agreement between you and IAG Performance regarding use of the website and purchase of products.
Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
No waiver: Our failure to enforce any provision does not waive our right to enforce it later.
Assignment: We may assign our rights and obligations under these Terms without notice. You may not assign your rights without our consent.
Notices: We may provide notice by email, posting on the website, or other reasonable means to the contact information you provide.
